THERAPEUTIC USE AUTHORIZATIONS: PROCEDURE

The FIPV has had an agreement since 2005 with the AEPSAD (Spanish Sports Health Protection Agency) to carry out anti-doping controls and procedures.

As an athlete, you may be sick or suffer from physical conditions that require medical treatment to recover. If the active ingredients of the medication you use appear on the List of substances and methods prohibited in sport, you must request a Therapeutic Use Authorization (TUE) . To help you know if your medication requires a TUE, the AEPSAD makes the mobile phone and desktop application available to you NoDopApp.

A TUE is a certificate issued by the National Anti-Doping Organization of Spain, AEPSAD, or the FIPV and that authorizes you to use, through one route of administration, in specific doses and for a period of time, a medication that contains prohibited substances. on the sport.

Conditions for granting a Therapeutic Use Authorization (TUA)

To grant the TUE, through the application you must:

  • Demonstrate through accurate reports and clinical tests endorsed by a doctor that you suffer from a disease.
  • That the prohibited substance or method in question is necessary to treat an acute or chronic medical problem of such a nature that your health would experience significant deterioration if untreated.
  • That it is very unlikely that the treatment will produce an improvement in your performance greater than that which could be anticipated upon returning to your normal state of health.
  • That there is no reasonable Therapeutic alternative to the use of the prohibited substance.

The last person responsible for the request is the athlete or his legal representative, if he is a minor.

TUE application process

Where should it be requested?

Depending on the competitive level of the athlete, it may happen that:

  • If you are International and compete regularly in international events, you must request the TUE from the FIPV. In this sense, the athlete must submit a request for recognition of said TUE to the corresponding International Federation. If such a TUE meets the criteria set out in the International Standard for Therapeutic Use Authorizations, the International Federation should recognize it.
  • The athlete or the AEPSAD/FIPV will have 21 days from the date of notification of the lack of recognition to raise the issue with the World Anti-Doping Agency (WADA), maintaining the validity of the TUE during the period that elapses until the decision of the AMA.
  • If you are national, you must request the AUT from the AEPSAD. Applications approved at national level are usually subsequently recognized by the International Federation.

When does it have to be requested?

Any Athlete who needs a TUE must request one as soon as possible.

  • For substances prohibited only in Competition, you must request the TUE at least 30 days before your next competition, unless it is an emergency or an exceptional situation.
  • In the case of substances prohibited at all times, the TUE application must be submitted as soon as the problem is diagnosed.
  • In emergency situations (retroactive), the request must be sent within 10 days from the start date of treatment, along with reports justifying the emergency situation. It is essential to specify in the request the aforementioned start date of the treatment (Request that it be authorized with retroactive effect).

How to apply?

There are three options so you can submit your AUT application:

  • Through ADAMS; You can request from AEPSAD an account in ADAMS (anti-doping administration and management system created by WADA) . From the AEPSAD we will send you a username and password so that you can fill out the application form online and attach the corresponding medical information. You will be able to follow the status of your application in real time. Furthermore, ADAMS allows you to know the results of the doping controls to which you may be subjected. This is the fastest way, and without a doubt we recommend it.

  • You must download the TUE application form from the Anti-Doping Organization website. Once completed and together with the medical tests, all documentation will be sent by postal mail. In the case of the AEPSAD: Postal mail: CAUT. Plaza de Valparaíso number 4, 28016 Madrid.

In the last two cases, the Anti-Doping Organization will enter the information into ADAMS.

The AEPSAD/FIPV will not accept for processing any application that is not correctly completed and without the relevant medical documentation.

Assessment of the TUE application at the FIPV

Once the application is received, a first review is carried out at the FIPV to determine if the documentation is complete; The application then goes to the assessment of the Committee for Authorizations for Therapeutic Use (CAUT) of the FPV, who will independently and professionally assess your application. The CAUT acts with full functional autonomy in the performance of its duties.

TUE approval

The AUT is valid from the date indicated by the CAUT and during the period specified in the decision issued. The Therapeutic Use Authorization Committee will make its decision normally within a period of 21 business days from receipt of all the necessary documentation.

If you use the prohibited substance before the TUE has been approved, you do so at your own risk; such use would constitute an anti-doping rule violation if the TUE were denied by the CAUT. However, in situations of true medical emergency the Athlete's health should never be put in danger for administrative reasons.

Communication of the decision

By certified postal mail, with the FIPV itself informing you in writing of the decision adopted, in at least two languages (Spanish or English or French). In addition, all the information related to the file that supports the TUE application will be available in ADAMS so that you can consult it or generate a certificate when you need it.

Recognition of AUTs.

Loading the TUE request into ADAMS allows information to be shared between Anti-Doping Organizations and therefore avoids redundant bureaucratic procedures. Article 4.4 of the World Anti-Doping Code requires Anti-Doping Organizations to recognize TUEs granted by other Anti-Doping Organizations that satisfy the conditions set out in Article 4.1 of the International Standard for Therapeutic Use Authorizations.
